There are many choices to be made when shopping for auto insurance. The obvious choices might be the cost, company reputation and customer service. Other important concerns are the types of coverage that you choose to protect you and your family or other members in the household. One of the most important choices of coverage is whether to select Limited Tort or Full Tort.
When choosing the Full Tort option, you will maintain an unrestricted right for you and the members of the household to seek financial compensation for injuries caused by other drivers. Financial compensation would include vehicle damage, loss of wages, medical expenses as well as pain & suffering. Compensation would also apply if your injuries were not defined as "serious" as stated under the auto policy.
When choosing the Limited Tort option, you're limiting your right and the right of members of your household to seek financial compensation for injuries caused by other drivers. Under Limited Tort, you and other members of the household, that would be covered under the auto policy, may seek recovery for all medical and other out of pocket expenses, but not for pain & suffering. Also, you may not collect for non-monetary damages unless the injuries suffered fall within the definition of "serious injury" as set forth in the auto policy. A "serious injury" has been defined as death, disfigurement or serious impairment of a bodily function. Other exceptions noted in the auto policy would apply to involvement with a drunk driver or an "out of state" driver.
